Independent Workplace Investigations

If your business needs a professional independent investigation into a complex matter in the workplace, please call us on 07918 015846 to discuss your needs in confidence.

We have over 20 years of experience in conducting specialist and complex workplace investigations. Swift HR will ensure that the investigation is fair and objective, and conducted thoroughly, confidentially, efficiently, and with regard for the wellbeing of all concerned. All investigations are conducted in line with the ACAS Code of Practice and associated guidance.

Our HR Consultants are trained and experienced in investigating:

  • a wide range of misconduct allegations.

  • capability and performance concerns.

  • grievances and complaints (individual or collective).

  • bullying and harassment complaints.

  • discrimination allegations (covering all of the protected characteristics defined within the Equality Act including sex, sexual orientation, disability, age, gender reassignment, race, religion or belief, marriage and civil partnership and pregnancy and maternity).

Swift HR can also advise you about suspension of employees, or other control measures during an investigation which may be needed to manage risk. In addition, we will highlight and help you to manage any external reporting requirements such as safeguarding referrals, police involvement for criminal matters, Information Commissioner’s Office, RIDDOR reportable injuries, and so on.

We carefully plan investigations, agreeing the scope, terms of reference and timescales with you before starting, and communicate progress effectively throughout. We also retain a clear focus on the wellbeing of all involved in the investigation, using a compassionate and non-confrontational approach to reduce the stress on your people.

Our HR Consultant will also recommend supportive measures which you as an employer may be able to put in place, and will ensure that reasonable adjustments to the investigation process are made for those with a disability. This approach protects your relationships with your employees, their working relationships with each other, the health and wellbeing of your people and supports everyone’s ability to successfully find closure after the case has ended.

By helping employees to feel safe and comfortable with the investigation, recognising the benefits of it for them, this improves their engagement in the investigation and the outcomes of the process as a whole.

Following the investigation, our independent investigator will deliver a clearly written (easy to read) report outlining the methodology of investigation, the findings and evidence, and an impartial and rigorous assessment in relation to the allegations or complaint. The report will provide a conclusion about what did or did not happen and make clear whether there is a case to answer or not, based on the available evidence. This enables your business to make decisions which are evidence-based, credible, and legally compliant. The investigation report and bundle of evidence is structured and suitable for use during formal employment processes and employment tribunals.

Sometimes allegations and complaints can arise in clusters, necessitating a wider workplace investigation. In cases where there are multiple allegations and multiple parties, Swift HR can complete these complex investigations promptly and efficiently to enable you to bring matters to a resolution.
